The following Contest is intended for viewing in the 50 United States and D.C. only and will be construed according to, and governed exclusively by California Law. Do not proceed in this site if you are not a legal resident of the 50 United States or D.C., 18 years or older, and accessing this site in the United States.
“BIGGEST BUCK COMMANDER FAN” CONTEST
2015 OFFICIAL RULES
PARTICIPATION CONSTITUTES ENTRANT’S FULL AND UNCONDITIONAL AGREEMENT TO THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR AND JUDGES, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THIS CONTEST.
ELIGIBILITY: The Biggest Buck Commander Fan Contest (“Contest”) is open to legal residents of the Continental U.S. who are eighteen (18) years of age or older at time of entry. Employees, officers and directors of The Outdoor Channel, Inc. ("Sponsor"), K2 Marketing Group, Inc. (“Administrator”), their parent companies, subsidiaries, affiliates, TV production partners, advertising agencies, promotional suppliers (collectively, "Contest Entities") and the immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible. All applicable federal, state, and local rules apply. Void in Alaska, Hawaii, and where prohibited or restricted by law.
HOW TO ENTER: Between 12:00:00 AM ET on June 15, 2015 and 11:59:59 PM ET on July 4, 2015 (“Contest Period”), eligible participants can enter the Contest using one of the two methods of entry outlined below. For these entry methods, first create your video that explains why you should be named the Biggest Buck Commander Fan (“Video”). Note that only the entrant may appear in the Video. Videos will be judged according to the process outlined in these rules. The two entry methods are:
- Instagram Post: Share your Video on your personal Instagram page and tag your Video with #buckcommander in the caption of the Video for an entry into the Contest
You must have a public Instagram account. If you do not have an Instagram account, you may sign up for a free Instagram account at http://instagram.com.
- Twitter Post: Send a non-private Tweet with your Video and the #buckcommander for an entry into the Contest.
You must have a non-private Twitter account. If you do not have a Twitter account, you may sign up for a free Twitter account at www.twitter.com.
When entering via a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Entries must be in compliance with the Entry Requirements outlined below. Videos must also comply with any applicable submission requirements as dictated by the social media platform used for Entry. A participant may enter and submit/post as many Videos as they like during the Contest Period. This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter. Enter using an Instagram or Twitter account registered in your name. Multiple entrants may not share the same Instagram or Twitter account. In the event of a dispute, the natural person associated with the Instagram or Twitter account used to enter will be deemed to be the Contest entrant.
For the avoidance of doubt, entrant must own or have the right to convey any and all right, title and interest in and to the Video. Submitting a Video that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you. If the Video was filmed by anyone other than the entrant, the entrant represents and warrants that such person(s) have assigned him/her all rights in the Video. The form of any such permission or release will be as solely determined by, or acceptable to the Sponsor. Failure by Sponsor to request such permission(s) and/or release(s) is not a waiver of Sponsor’s right to require same, and the entrant acknowledges that failure to comply with any such request may cause disqualification. Other than for winner notification, neither Sponsor, nor anyone acting on its behalf, will enter into any unsolicited communication with any entrant regarding this Contest, nor will entries be acknowledged or returned. By submitting a Video, the entrant agrees to indemnify and hold harmless Contest Entities from any action or liability resulting from the publishing of his/her Video and/or use of the Video as otherwise permitted by these Official Rules.
ADDITIONAL REQUIREMENTS FOR VIDEO ENTRIES: Videos may not exceed 30 seconds in length, may not exceed 25MB in size, and must be in either WMV or MOV format. Audio and video must be clear and audible. If a Video is unable to be viewed by the Sponsor and its agents for any reason whatsoever, that Video shall be disqualified (and Contest Entities will not be responsible or liable for any such inability).
Do not include any music in your Video. Do not include any branded products, trademarks or logos in the Entry Video, other than trademarks or logos owned by The Outdoor Channel, Inc. Entries which contain a trademark or logo or promote any brand or product other than those belonging to The Outdoor Channel, Inc. may be disqualified at the Sponsor’s sole discretion; however, Sponsor may choose not to disqualify an Entry which includes a trademark or logo if Sponsor determines in its sole discretion that the inclusion of such trademark or logo is incidental. Entrant may be asked to sign an affidavit stating that Entrant was not paid a fee, either monetary or in-kind, to promote an included trademark, logo or branded product.
Videos may not use any commercially copyrighted images, and may not contain any personal identification information, including last name or city of residence. Any elements that appear in the Video must be entirely original, created by the entrant, or be in the public domain. Use of any elements that are not original or in the public domain will result in disqualification of a Video, at Sponsor’s sole discretion. Entries that do not include all required information and do not adhere to the foregoing and following requirements will be considered void and will not be considered in the judging of this Contest. Sponsor reserves the right in its sole discretion to disqualify any Video at any time which, in the Sponsor’s reasonable opinion [a] is deemed to be immoral, obscene, profane, defamatory or not in keeping with Sponsor's image; [b] describes dangerous conduct, stunts or tricks that could lead to physical injury or property damage; [c] endangers the safety or wellbeing of any person or animal; [d] contains any third party materials or otherwise violates or infringes (or may infringe) on any copyright, trademark, logo or other proprietary right of any company, or any person living or deceased; [e] defames or invades the privacy or publicity rights of any person, living or deceased; or [f] is in violation of these Official Rules.
ENTRANT’S REPRESENTATIONS: By submitting a Video, you represent and warrant that [a] the Video does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, and does not defame any person or identify any person by name or other identifying information, [b] the Video has not previously been entered in any other contest, [c] the Video has not been previously published in any medium, [d] the Video does not violate any law or regulation, [e] you own all rights to your Video (including, without limitation, any copyrights contained therein), [f] you agree to waive any claim for reimbursement for any equipment or materials necessary to submit a Video regardless of whether or not that Video is selected for the prize. Sponsor's determination as to whether any Video potentially violates the rights of any third party is final.
SPONSOR’S RIGHTS TO ENTRIES: Entries become the property of Sponsor and will not be acknowledged or returned. By submitting a Video, you grant the Sponsor and its affiliated companies the unconditional and perpetual right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use the Video (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party. By submitting a Video, you forever waive any rights of copyrights, trademark rights, patent rights, privacy rights, and any other legal or moral rights in the Video that may preclude the Contest Entities’ use of the Video, or require your permission for the Contest Parties to use the Video. By submitting a Video, you further agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against any Contest Entity, or any other person, on the grounds that any use of the Video, or any derivative works, infringe any of your rights, including, without limitation, copyrights, or moral rights. You further acknowledge that the Sponsor is in no way obligated to broadcast, publish or use your Video in any way. Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and the Sponsor. In no way are you to be construed as the agent or to be acting as the agent of the Sponsor.
JUDGING CRITERIA & CONDITIONS:
The Contest consists of two (2) rounds of evaluation. In Round One, a team of Outdoor Channel judges (“Judges”) will evaluate the entries based on the following criteria (“Judging Criteria”):
- Personality of the entrant and suitability to tour for one day at Buck Commander Headquarters (50%)
- Originality (25%)
- Adherence to the Contest theme (25%)
Up to 10 of the top entries will be selected as Finalists and proceed to Round Two.
Judges will use the same Judging Criteria in each round. In the event of a tie in Round One, the judges will select the winner using the Personality of the entrant criterion score as a tiebreaker. In Round Two, an individual from the show Buck Commander will evaluate the top entries from Round One and select the Prize winner based on the Judging Criteria.
PRIZE: One (1) Prize will be awarded consisting of a trip for two (2) people (the winner and one (1) guest) to Monroe, Louisiana, where the winner will have the opportunity to tour for one (1) day Buck Commander Headquarters with one (1) or more members of the Buck Commander staff. The prize includes round trip coach air travel to Shreveport, LA or Jackson, MS from a major commercial airport near winner's residence (as determined by Sponsor); one (1) double-occupancy hotel room for two (2) nights in Monroe, LA; ground transportation to and from the airport and the Buck Commander Headquarters; Tour of the Buck Commander Headquarters; and a meal during the tour. Approximate Retail Value (“ARV”) of Prize is $4,150. Actual value will be determined by winner's residence and seasonal rates. All expenses not specified are winner’s responsibility. Travel and accommodations are subject to availability and certain restrictions; blackout dates may apply. Air carriers, hotels and other transportation selected by Sponsor. Trip must be taken at a time to be determined by Sponsor. Prize will be forfeited if winner is unable to travel during designated time period. Winner and guest must travel on the same itinerary and are responsible for obtaining all necessary travel documents. Travelers are responsible for any travel insurance. All other costs and expenses associated with prize acceptance and use not specified herein as being provided, including transportation, luggage fees, meals, souvenirs, and gratuities, are the sole responsibility of the winner. If for any reason, the Sponsor is unable to provide any portion of the prize, no compensation will be awarded in lieu thereof, but remainder of prize package will be awarded. If the winner lives within 100 miles of Monroe, LA (as determined by Sponsor), Sponsor reserves the right to substitute ground transportation in lieu of airfare at its sole discretion, and any difference in value will not be awarded.
Winner must comply with any applicable hotel check-in requirements, such as presentation of a major credit card. In the event the winner engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the winner and his or her travel companion home with no further compensation. The restrictions and conditions stated herein are not all-inclusive and the described above may be subject to additional restrictions and conditions, which may be stated in any correspondence with Sponsor or other travel documents.
No prize transfer or cash redemption permitted, except at the sole discretion of Sponsor. No prize substitution or modification, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded.
WINNER SELECTION / NOTIFICATION:
Potential Contest winner must comply with these Official Rules in order to accept the prize and be confirmed as the official Contest winner. On or about July 15, 2015, the potential Contest winner will be notified by one of these two methods:
- Instagram Post: Administrator will comment on the potential Contest winner’s Video on Instagram. Potential Contest Winner must respond to Sponsor by email to customercare@K2usa.com within three (3) days of notification and provide Sponsor with an e-mail and physical address.
(Instagram note: In order to receive such comment, you must (a) be following @OutdoorChannel and (b) must have your "Photos are Private” account setting set to "OFF" so that your Instagram profile is public. You can change your account settings back thirty (30) days after the Contest has ended).
- Twitter Post: Administrator will notify the potential Contest winner via a direct message from @OutdoorChannel to the potential Contest winners’ Twitter Account used to enter the Contest. Potential Contest Winner must respond to Sponsor by email to email@example.com within three (3) days of notification and provide Sponsor with an e-mail and physical address.
(Twitter note: in order to receive such direct message, you must (a) be following @OutdoorChannel and (b) must have your account settings set to “unprotected” or “public”, you can change your account settings back thirty (30) days after the Contest has ended).
An affidavit of acceptance, liability and publicity release (“Release”) as well as a W-9 Form will then be sent to the potential Contest winner’s email and such potential Contest winner will have to execute and return the Release and W-9 form within five (5) calendar days. Contest winner will be sent a 1099 form for the actual value of their prize and will owe such taxes at the end of the calendar year. If in any instance, notification attempt(s) for the prize winner fail for any reason, a potential contest prize winner fails to provide requested information and/or return the Release and/or W-9 Form within the time specified, or if a potential Contest winner is found to have not complied with these Official Rules, the prize will be forfeited and the runner-up potential Contest winner may be selected and notified. Contest Winner’s Guest, who must be 18 years of age or older, will be required to complete and return a Release prior to issuance of travel documents.
The potential Contest winner and his/her guest will be required to submit to, and cooperate in, a confidential background check to confirm eligibility and to help ensure that the use of any such person in advertising or publicity for the Sponsor or this Contest will not reflect unfavorably on the Sponsor, as determined by the Sponsor in its sole discretion.
By accepting the Prize, the Contest winner and his/her guest represent that they understand that travel, whether by plane, automobile, or other conveyance, or by foot, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, or other agencies, known or unknown. The Contest winner and his/her guest further represents that they recognize that such risks may be present at any time before, during and after the trip. In order to be considered the Contest winner and partake of the enjoyment of this trip, Contest winner and his/her guest must be willing to accept the risk, and to confirm their acceptance to such risk in writing at Sponsor's request.
DISPUTES/GENERAL: All taxes on prize and all expenses related to acceptance and use of the prize not specified are the sole responsibility of the Contest Winner. By participating, entrants agree: [a] to these rules and decisions of Sponsor and judges, which shall be final in all respects relating to the Contest; and [b] to release, discharge and hold harmless Contest Entities, together with the respective parents, subsidiaries, officers, directors, employees, representatives, agents, shareholders, successors and assigns of each (aforementioned individuals and organizations collectively, the “Releasees”), from any and all injuries, liability, losses and damages of any kind resulting from their participating in the Contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy; and [c] to permit Sponsor to use his or her name, Videograph, likeness, Video and other submitted materials, biographical information, voice, voice likeness, and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to within Sponsor's websites in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Releasees are not responsible for and shall not be liable for: [a] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [b] failed, incomplete, garbled or delayed computer transmissions; [c] late, lost, misdirected or incomplete entries; or [d] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest or any portion thereof should viruses, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion and to award the prizes from among all eligible entries received prior to such action taking place. In the event of any discrepancy between these Official Rules, abbreviated versions or Contest-related advertising or disclosures, these Official Rules shall prevail. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial contest and sweepstakes subscription notification and/or entering service sites. Any person who enters by any of the methods described above will be disqualified. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules.
INDEMNIFICATION: You agree to indemnify and hold the Contest Entities harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Entities due to or arising out of your Entry, or your conduct in creating an Entry or otherwise in connection with the Contest, including but not limited to: claims for trademark infringement; copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation.
GOVERNING LAW: This Contest is governed by the laws of the State of California, with jurisdiction and venue in Riverside County, California, and all claims must be resolved in the courts of Riverside County, California.
WINNER LIST: For the name of winner, mail a self-addressed, stamped envelope to be received by August 3, 2015 to: “Biggest Buck Commander Fan Contest” Winner, c/o K2 Marketing Group, Inc., 153 Telemark Court, Steamboat Springs, CO 80487.
